Who is responsible for your information

AgStrive LLC (trading as AgStrive) is the responsible party for the information you give us when you apply. Postal address: 7888 710th Ave, Tintah, Minnesota 56583, United States. Privacy questions: privacy@agstrive.com.

This notice covers the application stage only. If your application is accepted, you will receive a fuller notice before any case, document or employment record is created.

What we collect

From a farm: the contact person's name, email and phone; farm name, state and town; the work, number of workers, first date of need and season end; housing status; prior H-2A experience; any notes you add.

From a worker: your name, email and phone; country and town; your skills, experience, English level and availability; whether you hold a passport (never the number); prior H-2A experience; who referred you.

We do not ask for dates of birth, passport or ID numbers, or any document at this stage. We record the date and version of the notice you agreed to, and a one-way hashed network token used only to stop abuse.

Why we use it and on what basis

To review your application, contact you about it, and prepare H-2A services with you if you proceed. We rely on your consent and on the steps needed before entering an agreement with you (for South African applicants: POPIA section 11(1)(a) and (b)).

We make no automated decisions about you. A named AgStrive person reviews every application.

Who sees it

AgStrive staff who review applications. Our processors: Supabase (database and email delivery) and Vercel (hosting), both in the United States, and Resend for transactional email once enabled. We do not sell or share your information for advertising.

For South African applicants: your information is stored and processed in the United States. By applying you agree to this transfer (POPIA section 72). You can withdraw that consent at any time by emailing us; we will then stop processing and de-identify your application.

How long we keep it

Applications that are declined or withdrawn are de-identified 12 months after the decision. Accepted applications become part of your client or worker record and follow the H-2A record period of three years after the season ends.

Your rights

You can ask to see, correct or delete your application, object to our use of it, or withdraw consent, by emailing privacy@agstrive.com. We respond within 30 days. South African applicants may also complain to the Information Regulator of South Africa; US applicants may contact their state attorney general.

Workers never pay

No worker ever pays AgStrive, a farm, or any recruiting partner a fee for a job, an application, or a visa process. If anyone asks you for money, tell us at privacy@agstrive.com. Applicants must be 18 or older.

Security and changes

Applications are stored in an access-controlled database; every staff view and action is recorded in an audit log. This is an interim notice pending review by counsel. When it changes we publish a new version with a new effective date, and your application keeps the version you agreed to.
